By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions ("Terms of Service") and will not attempt to replicate or clone any products. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if information on this site is inaccurate, incomplete, or out of date. The content is provided for general information and should not be relied upon as the sole basis for making decisions without consulting more accurate sources. Any reliance on the material is at your own risk. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

The steps required by you to enter into a contract with us are that you place your order for the products by clicking on the pay now button at the end of the checkout process once your product information, payment details and personal information have been submitted. You will be guided through the ordering process by our website and its instructions. Please take time to ensure that your order details are correct.

Once you have submitted an order, we will send you an acknowledgment email detailing the products you have ordered. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. This email acts simply as an acknowledgment that your order has been submitted and will be processed by us, not that the order is confirmed or accepted.

Please note all orders are subject to stock availability. We will inform you by email as soon as possible if the product you have ordered is not in stock. If you have already paid for the product and it is not in stock, we will refund you the amount you have paid.

Your order will be accepted and confirmed by us when the products have been dispatched. A further email will be sent to you when your ordered products have been dispatched. The contract between you and us will only be formed once you have received an email confirming dispatch of the order. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation. We reserve the right to refuse service to anyone for any reason at any time.

Non-acceptance of an order may arise from a number of reasons including (but not limited to):-

·         Not being able to take payment from you;

·         A pricing or product description error on our behalf;

·         You not meeting any eligibility criteria;

·         Unavailability of stock;

·         If we reasonably consider that you intend to re-sell the products on a commercial basis;

or

·         Attempting to purchase more than four products of any type of product within a single order.

Please note we will not file a copy of the contract between us.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We cannot guarantee that your computer monitor's display of any colour will be accurate. We will ship pre-ordered goods to you within a reasonable timeframe, which we will estimate at the point of pre-order. If the goods fail to arrive for any reason, then we will contact you within a reasonable timeframe to arrange a refund. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person or geographic region. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

PRODUCT AND SERVICE AVAILABILITY

Certain products or services may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy.

PROMOTIONAL DISCOUNTS AND GIFT VOUCHERS

Only one discount code can be applied per transaction. Discounts cannot be used in conjunction with other offers or on delivery charges. If you return an item purchased with a discount, only the amount paid will be refunded. Promotional Discounts cannot be used when purchasing Gift Vouchers. Gift Vouchers are non-refundable and cannot be exchanged for cash. Any promotional offer is valid only for use as part of a purchase made via www.oxfordshirt.co.uk, unless otherwise stated. Certain products may be excluded from discounts at our discretion. Such promotional offers, discount codes and gift vouchers are not valid for use as part of a purchase in our shops, trade stands or offices.

PRICING AND PAYMENT

The prices of the products will be as quoted on our website from time to time. We take all reasonable care to ensure that the prices of products are correct at the time when the information was entered onto the system.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof including our prices) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We will normally check prices as part of our dispatch procedures. If the products are incorrectly priced, then where the product’s correct price is less than the price stated on our website, we will charge the lower amount. However, please note that if the pricing error is obvious and unmistakeable and could reasonably have been recognised by you as mispricing, we do not have to provide the products to you at the incorrect (lower) price.

Where the product’s correct price is higher than the price stated on our website, we will contact you  as soon as possible to inform you of this error. We will give you the option of continuing to purchase the product at the correct price or cancelling the order. We will not process the order until we have your instructions. If we are unable to contact you within seven (7) calendar days using the personal information you provided to us, we will treat the order as cancelled and notify you in writing.

The price of the product does not include delivery charges. Our delivery charges are as quoted on our website from time to time.

You can only pay for your products by using a debit card, credit card or PayPal. The cards we accept are shown at the time of ordering. Payment for the products and all delivery charges is in advance.

DELIVERY AND SHIPPING

We will aim to deliver your order by the estimated delivery date set out on the website, unless there is an event outside our reasonable control. We reserve the right to deliver goods up to 28 days after date of order although we expect to process orders within the estimated delivery dates as set out on the website. For stock purposes, each item requested constitutes an individual order. We will always attempt to consolidate multiple orders in one shipment. Due to stock and packaging requirements, Products may be shipped over several days and in more than one package.

If we’re unable to meet the estimated delivery date due to any act or event beyond our reasonable control such as (but not limited to) natural disasters, floods, earthquakes, epidemic, IT failures or attacks, strikes, late deliveries by couriers or other delivery organisations, civil commotion, terrorist attacks or threats of such terrorist attacks, impossibility or delays resulting from using railways, shipping, aircraft, motor transport or other means of transport, then we will inform you of a revised estimated delivery date.

Delivery will be completed when we attempt to deliver the products to you or a person identified by you to the address you gave to us or other address or location which is agreed between you and our courier.

The products will be your responsibility from the completion of delivery being attempted.

You will own the products when we have received payment in full for the products, including any delivery charges.

International orders may be subject to import duties and taxes, which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.  

RETURNS AND REFUNDS

We’re sorry that we cannot make changes or cancel an order once you have placed it. If you wish to return an item or are not happy with an item, please return it using the Returns Process. It is your responsibility to return the item to us along with proof of postage. To ensure we’re able to return all items to their original presentation so they can go on to be enjoyed by another customer, we charge a small returns fee, the amount of which can be found of on our returns page. This charge will be deducted from your refund. We will not apply a returns fee if you have received an incorrect item, or are returning a faulty item.

You may return items within 28 days of delivery for a full refund if they are in their original condition with tags attached. Items such as underwear, swimwear, and socks cannot be returned for hygiene reasons. Returns are subject to a processing fee, details of which can be found on our Returns page.

For items returned back to us outside of our policy we reserve the right to refuse refunds or exchanges. None of these rules affect your statutory rights. If you return an item requesting a refund within 14 days of the item being delivered to you, we'll give you a full refund by way of the original payment method. If you request a refund for an item during the above time frames but you can't return it to us for some reason, please get in touch - but any refund will be at our discretion. We don't accept returns for unwanted items after the relevant returns period above. If you try to make a return, we may have to ask you to collect it from our warehouse or donate it to charity on your behalf.

Any item which is purchased as part of a multi-buy promotion which is then later refunded will invalidate the offer.

We may extend or reduce our refunds policy at certain times. Please see the ‘Returns' page for our returns policy at the time you order. The return conditions must be met for a full refund.

Whilst you are deciding whether to keep your purchases, you do have a legal duty to take reasonable care of the items. Unless they are faulty, all products must be returned in a re-saleable condition. This means the product and its packaging, labels and tags are undamaged and unused. We will not accept worn, damaged, altered or used goods. We reserve the right to reduce the amount of monies refunded (up to the value of the contract price) where the value of the goods are diminished from your handling of the goods which goes beyond what is necessary to establish the nature, characteristics and functioning of the goods. We shall evaluate the condition of the product by considering if your handling goes beyond that which might reasonably be allowed in a shop and the general wear of the product. We will not accept the return of any made-to-measure or customer-made products. If we have to contact you or give you notice in writing, we will do so by email or by post to the address you provide to us when ordering the products.

Where goods are ordered for studio, wardrobe, production, styling or any other commercial purpose, the order is treated as a business order and is not eligible for change-of-mind returns. Items worn other than for a brief try-on, including for shoots, filming, productions, fittings, events or styling sessions, are not returnable unless faulty or unless we have agreed to the return, in writing, in advance.

Any refund made will be made on the credit card or debit card used at the time of ordering the products or services or by PayPal. We aim to process Refunds within five (5) working days of products being received back or us accepting a cancellation for services. If the product is faulty or not as described, your legal rights are not affected by the above returns policy. Please say if you consider the products are faulty or not as described.

PRODUCT DESCRIPTIONS

The images of our products are for illustrative purposes only. We make every effort to ensure the images and colours are accurate but we cannot guarantee the images and colours on your computer are exactly the same as the product. The products may vary slightly from those images.

PRICING AND VAT

The price of a product includes VAT (where applicable) at the current rate chargeable in the United Kingdom. However, if the rate of VAT changes between the date of your order and the date of delivery, we may adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect. Prices are subject to change without notice. For orders shipped outside the UK, customers are responsible for any import duties or taxes.

LIABILITY

We accept no liability for any losses or damages arising out of or in connection with our breach of these terms or our failure to use reasonable skill and care to provide services which are not reasonably foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, we both knew it might happen e.g. you discussed it with us when placing an order.

Nothing in these terms shall exclude or limit our liability for personal injury or death caused by our negligence or for fraud or fraudulent misrepresentation.

You agree not to use the products for commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, loss of revenue, business interruption or loss of business opportunity.

SEVERANCE

Each of the paragraphs of these terms operate separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

This website may contain links to third-party websites. We are not responsible for examining or evaluating the content or accuracy of these websites. We assume no liability for any third-party products or services. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

COMMENTS AND USER CONTENT

The contract is between you and us. No other person shall have any rights to enforce any of its terms and the contract cannot be assigned or sub-contracted to anyone else.

Even if we delay in enforcing the contract between us, we can still enforce it at a later date.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice, including after you have placed your order.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). COMPETITIONS

Occasionally we may run competitions via Instagram our website or other platforms. One prize will be drawn from all entries submitted through Instagram. Entrants can enter the competition by tagging @oxfordshirtco account on an Instagram post. Automated or bulk entries will not be accepted. The prize is non-transferable, non-refundable and non-changeable. Where The Prize Draw prize is made up of store credit this credit can only be used against RRP prices of our products. Strikethrough prices are excluded. The credit must be used in one go and is valid for one month only. There is no cash alternative. The odds of winning will depend upon the numbers of entrants. The Prize Draw is open to all UK and Channel Island residents over the age of 18. Oxford Shirt Company Ltd accepts no liability for (a) late, lost, misdirected, incomplete, offensive or illegible entries, (b) any and all electronic, network, computer or other technical malfunctions or any human error that may happen upon collection, processing and transmission of data, or (c) any type of graphical or other error in the posting of the Prize Draw or in the administration of the Prize Draw. Acceptance of any Prize shall constitute and signify the Winner's agreement and consent that Sponsor / Third Party Partner may use the Winner's name, address, and/or Prize information for promotional purposes without further payment or consideration. We will not enter into correspondence over the picking of the winning entry. By entering our competitions, you are confirming that you are 18 years of age or over and that you consent to Oxford Shirt Company and our third-party partner adding your email address to their databases, and consent to receiving marketing emails from both Oxford Shirt Company and the third-party partner. These parties shall be listed on each competition page whilst live. The competitions are open to UK residents only. Stock availability applies. Sale / Markdown and discounted price products are excluded. Credit is non-transferable, non-refundable, non-changeable and valid for a total of six months. There is no purchase requirement to enter the competition and only one entry is allowed per person.
